Welcome to Smashmeisters. These Terms of Service ("Terms") govern your access to and use of the Smashmeisters website at smashmeisters.com and any related pages, features, and services (together, the "Site"), and your purchase of products from us. The Site and the Smashmeisters brand are operated by Smashmeisters LLC ("Smashmeisters," "we," "us," or "our").
By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
Smashmeisters is a custom golf apparel brand offering printed polos, T-shirts, outerwear, accessories, and made-to-order custom items through our Shirt Builder. You can reach us at contact@smashmeisters.com.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to make a purchase. If you are under that age, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms. By placing an order, you confirm that you meet these requirements and that the information you provide is accurate.
3. Your account
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us right away at contact@smashmeisters.com if you believe your account has been accessed without your permission. We may suspend or close an account that we reasonably believe has been used in violation of these Terms.
4. Products, sizing, and colors
We work to display our products, colors, and details as accurately as possible. Actual colors may vary depending on your screen, and product photos are for illustration. Please review sizing and product descriptions before ordering. We reserve the right to correct errors, update product information, and limit or discontinue products at any time.
5. Custom and made-to-order items
Items created through the Shirt Builder or otherwise personalized are produced specifically for you based on the color, size, style, and logo or embroidery options you select. You are responsible for confirming that your selections are correct before you check out.
Because these items are made to order, they are final sale and cannot be returned or exchanged, except where an item arrives defective or damaged or differs from what you ordered. This section applies in addition to our Returns policy.
6. Pricing and payment
All prices are listed in US dollars and may change at any time before you place an order. The price that applies to your order is the price shown at checkout.
Payments are processed by our third-party payment processor, Stripe. By submitting an order, you authorize us, through Stripe, to charge your selected payment method for the total shown at checkout, including any applicable shipping and taxes. You represent that you are authorized to use the payment method you provide. We do not receive or store your full card number; card data is handled directly by Stripe.
We reserve the right to refuse or cancel an order, including where we suspect fraud, pricing errors, or a violation of these Terms. If we cancel an order you have paid for, we will issue a refund to your original payment method.
7. Discount codes, promotions, and the Smash Society
We may offer discount codes and promotions, including a first-order discount for members of our email list, the Smash Society. Unless we state otherwise, codes and promotions cannot be combined, have no cash value, apply only while the offer is active, and may be changed or ended at any time. We may void a code that is obtained or used in a way we consider abusive or fraudulent.
8. Shipping and delivery
We currently ship within the United States. Shipping is free on qualifying orders as described at checkout, and a flat shipping charge applies to other orders. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when the carrier receives the order. We are not responsible for carrier delays once an order has shipped, but we will help you follow up where we can.
9. Returns, exchanges, and refunds
Eligible items may be returned within the window described in our Returns policy, which is part of these Terms. Custom and made-to-order items are final sale as described in Section 5. If an item arrives defective, damaged, or not as ordered, contact us at contact@smashmeisters.com and we will make it right. Refunds are issued to the original payment method once a return is approved.
10. Intellectual property
The Site and its content, including the Smashmeisters name, logos, designs, graphics, text, and images, are owned by Smashmeisters LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to view and use the Site to shop and place orders. You may not copy, reproduce, resell, or create derivative works from our content or designs without our prior written permission.
11. Acceptable use
You agree not to use the Site to break the law, infringe others' rights, interfere with or disrupt the Site or its security, attempt to gain unauthorized access to any system or account, scrape or harvest data, or submit false or fraudulent orders. We may restrict or end your access if you misuse the Site.
12. Third-party services and links
The Site relies on third-party services, including Stripe for payments and our hosting and email providers, and may link to third-party sites such as our social media pages. We are not responsible for the content, policies, or practices of third parties. Your use of their services is governed by their own terms and privacy policies.
13. Disclaimers
The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error free.
14. Limitation of liability
To the fullest extent permitted by law, Smashmeisters LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Smashmeisters LLC and its owners and employees from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
16. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Missouri, and you consent to the jurisdiction of those courts. Nothing in this section limits any right you may have to bring a matter in small claims court.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on the Site. Changes apply going forward. Your continued use of the Site after an update means you accept the revised Terms.
